URGENT ACTION

OPEN LETTER

As a consequence of our nationalist position in defence of oil as the
driving force behind national development, the Colombian State has unleashed
a ferocious persecution of the Oil Workers Union (USO).

It was our struggle that gave birth to the state oil company. ECOPETROL.
Today we are still fighting to prevent the privatisation of this company,
which belongs to all Colombians.

This persecution grew worse with the arrival of the neoliberal government of
Alvaro Uribe, slave to the multinationals, which, piece by piece, is
dismatling the political,labour and fundamental rights that were achieved
through the dignity and sacrifice of workers during their history of
struggle.

In the last 14 years, around a hundred valient USO leaders and activists
have been assassinated by State security forces and paramilitary groups; two
have been detained and disappeared; ten have been kidnapped; more than two
hundred have suffered the rigours of displacement from their places of work
so as not to meet the same fate as those before them; and several live in
exile abroad.

31 affiliates have been imprisoned for the crimes of rebellion, terrorism,
kidnapping, homicide and damage to property, among other things. In spite of
the bad intentions and manipulation of the Public Prosecutor's Office and
the State security bodies, the courts passed a verdict of not guilty in
favour of our USO comrades.

Currently, Ramon Rangel G, Alonso Martines, Luis E Viana and Jairo Calderon
are being deprived of their freedom, charged with rebellion by the Public
Prosecutor before a judge in Barrancabermeja.

The persecution against USO has reached such a point that our lawyers have
also been the victims of threats, harassment and assassination. Doctor
Eduardo Umana Mendoza was assassinated by hitmen in May 1998 when he was
defending Pedro Chaparro and Cesar Carrillo, among others.

My family has been a victim of this outrageous persecution, orchestrated in
particular by the DAS (secret police) and the 5th Brigade, who through
various forms of intelligence have made statements designed to link us with
members of the insurgency.

My father, Humberto Hernandez Gavanzo, who also belonged to the USO, the
National Association of Campesino Land Users (ANUC) and was a member of the
Regional Committee for Human Rights in Barrancabermeja, was assassinated on
19 March 1991. My brothers, Hector and Humberto, were criminally charged and
investigated by the Public Prosecutor for rebellion.

As if all that were not enough, in recent months the security bodies have
devoted themselves to fabricating evidence and paying witnesses in order to
try my widowed mother, Elvia Pardo, my brother Fabio Hernandez and myself,
for rebellion.

Because of my trade union activities, I have been the victim during the last
15 years of attacks, trade union persecution and threats on my life and
those of my family.

Convinced of my innocence, yesterday (23 October) I made a statement to a
lawyer acting for the National Centre for Human Rights, certain that there
is no evidence against me except what state security bodies have been able
to fabricate. As there was no evidence against me and I demonstrated that
all the accusations were false, the Public Prosecutor's Office deferred my
trial and decided not to detain me for the moment. From the date mentioned,
the Public Prosecutor has ten days to resolve my legal situation which he
can do in one of two ways: archive the case or take security measures, in
which case I would be detained.

My call continues to be for unity, organisation and struggle in the defence
of the interests of the people, of ECOPETROL, our convention and the USO,
and if a strike is necessary to defend this, we will decide to organise one
and carry it out.

I want to thank all of you, my trade union organisation and other trade
unions, for your solidarity on the day of my statement.

CARTA ABIERTA

Como consecuencia de nuestra posicion nacionalista en defensa del
petroleo como motor del desarrollo nacional, el Estado Colombiano ha
desatado una feroz persecucion contra la Union Sindical Obrera, USO.

Fue nuestra lucha la que dio origen a la estatal petrolera, ECOPETROL.
Hoy continuamos luchando para impedir la privatizacion de esta empresa,
patrimonio de todos los colombianos y colombianas.

Esta persecucion se arrecia con el gobierno neoliberal y de entrega a
las multinacionales de Alvaro Uribe que pretende de un destajo
desconocer los derechos politicos, laborales y convencionales
conseguidos con dignidad y sacrificios obreros, en historicas jornadas
de lucha.

Los ultimos catorce anos han sido asesinados cerca de un centenar de
valiosos dirigentes y activistas de la USO, a manos de organismos de
seguridad del Estado y grupos paramilitares; dos han sido detenidos y
desaparecidos; 10 han sido secuestrados; mas de dos centenares han
sufrido el rigor del desplazamiento de sus lugares de trabajo para no
correr con la misma suerte que los anteriores y varios se encuentran
exiliados en el exterior

Treinta y un afiliados han sido encarcelados entre otros por los delitos
de rebelion, terrorismo, secuestro, homicidios y dano en bien ajeno. Con
todo, y a pesar de la mala intencion y manipulacion de la Fiscalia
General de la Nacion y de los organismos de seguridad del Estado, los
jueces de la Republica han proferido sentencia absolutoria a favor de
los companeros de la USO.

En la actualidad estan privados de su libertad Ramon Rangel G, Alonso
Martinez, Luis E. Viana y Jairo Calderon, contra quienes la Fiscalia
emitio resolucion de acusacion por el delito de rebelion ante un juez de
Barrancabermeja.

La persecucion contra la USO ha llegado a tal punto, que nuestros
abogados han sido victimas de amenazas, hostigamientos y asesinatos,
como ocurrio con el doctor Eduardo Umana Mendoza, asesinado por sicarios
en Mayo de 1998, cuando era el defensor de Pedro Chaparro y Cesar
Carrillo, entre otros.

Mi familia ha sido victima de esta infame persecucion, dirigida
especialmente por el DAS y la V Brigada, quienes a traves de multiples
informes de inteligencia han hecho afirmaciones tendientes a vincularnos
como miembros de la insurgencia.

Mi padre, Humberto Hernandez Gavanzo, que tambien fue de la USO, de la
Asociacion Nacional de Usuarios Campesinos, ANUC, e integrante del
Comite Regional de Derechos Humanos de Barrancabermeja, fue asesinado el
19 de Marzo de 1991. Mis hermanos, Hector y Humberto, fueron vinculados
penalmente e investigados por la Fiscalia acusados del delito de
rebelion.

No conformes con todo lo anterior, en los ú;ltimos meses los organismos
de seguridad se han dedicado a fabricar pruebas y a ofrecer beneficios a
testigos que permitan judicializar, por delito de rebelion a mi senora
madre Elvia Pardo viuda de Hernandez, a mi hermano Fabio Hernandez Pardo
y a mi mismo.

En razon de mi actividad sindical he sido victima durante los ultimos
quince anos de atentados, persecucion sindical y amenazas contra mi vida
y la de mis familiares.

Convencido de mi inocencia, me presente ayer 23 de octubre a rendir
indagatoria ante una Fiscal Delegada adscrita a la Unidad Nacional de
Derechos Humanos con la certeza de que no existen pruebas en mi contra,
mas alla de las que hayan podido fabricar y presentar los organismos de
seguridad del Estado. Pese a que no existen pruebas en mi contra y que
al contrario, demostre que todas sus imputaciones son falsas. La
Fiscalia General de la Nacion me vincula al proceso y se abstiene por
ahora de detenerme. A partir de la fecha la Fiscalia tiene diez dias
habiles para resolver mi situacion juridica que puede ser en dos vias:
archiva el proceso o dicta medida de aseguramiento, que en este caso
seria la detencion.

Mi llamado sigue siendo a la unidad, la organizacion y la lucha en
defensa de los intereses populares, de Ecopetrol de nuestra convencion y
de la USO, y si para defender esto es necesaria la huelga, decidimonos a
organizarla y realizarla.

Quiero agradecer, a todos ustedes, a mi organizacion sindical y a otros
sindicatos la solidaridad recibida el dia de mi indagatoria.
