Urgent Action: S.O.S. SINDESENA Further Education

URIBE ORDERS REPRESSION OF WORKERS AND STUDENTS TO ELIMINATE PUBLIC EDUCATION

The Association for Investigation and Social Action NOMADESC and the below signed organisations affiliated to the "National and International Human Rights Campaign Against Privatisation, Corruption and the Criminalisation of Social Protest" denounce to the national and international community the serious attacks committed on 16th and 17th October against the Workers and Students of the National Learning Service SENA. [Translater note: SENA is a service for elder teenagers and young adults, corresponding to technical colleges and further education]

On 15th October the United Workers Federation CUT sent to a notice to the regional authorities informing them that "several unions affiliated to the CUT and social organisations will on 16th October carry out a march that will leave the SENA campus from 8:30 am. We are informing you so that you provide democratic guarantees for this activity." Nevertheless the peaceful march was repressed by the State Forces, on the order of the Mayor of Cali JHON MARO RODRIGUEZ using Decree No 0476 issued on 3rd October 2002.

Background

The workers in SENA are members of the trade union SINDESENA. The have used their constitutional rights of association and protest to hold a Permanent Assembly for the last 3 weeks, with the purpose of informing the national and international community that the policies of the ALVARO URIBE VELEZ , who has given directives to the Treasury Ministry to cut the service's budget.

By presidential order they are trying to cut the SENA budget by 395 million pesos (about £90,000 - at this one college) that would mean more than 50% cuts in 2003 and, as a result, an equivalent reduction in staff, changes to the teaching programme and cuts in the numbers of students. Nationally, 753,000 students benefit from SENA short courses; 78,000 students are on qualification courses; 45,000 are taking Professional Technical courses; 54,000 are on intermediate professional courses and 9,200 students are taking higher level technology courses.

The process of privatisation of public education that this government wants to impose is being materialised through these measures. They have obliged the workers to declare themselves in a permanent mobilisation. The workers have called protests and marches in many cities leading up to today's debate of the new budget in the Senate. The public actions in Santiago de Cali, the capital of Valle del Cauca department, and the city of Pasto which is capital of Nariño Departament, have faced repressive measures from the National and Municipal Governments, as we outline below:

The Facts

1. Santiago de Cali 16th October 2002

At about 10:30 in the morning, in the demonstration that was made in SENA dat Salomia, situated on 52nd street and second avenue, in the city of Santiago de Cali, members of the State Forces belonging to the Mobile Anti-Riot Squadron ESMAC, attacked harshly with tear gas bombs, shots risking the lives of the students and workers. They arbitrarily detained MIGUEL ANGEL HOYOS, President of the Valle del Cauca Branch of SENA , as well as students JUAN CARLOS BASTIDAS and HAROL ROMAN ESTUDIANTES. And they wounded with the tear gas bombs students DAVID VELASCO (who, despite his health problems making him use a wheelchair, was on the demonstration) PABLO GARCIA (wounded in the face by a Trooflay: grenade launcher) and SEBASTIÁN RUIZ.

2. Nariño 16th October 2002

Workers and students had formed the Caravan for the Defence of SENA, Nariño Section, located at number 11 - 05, East 22nd Street in the city of Pasto. They were inside the college when at about 12:10 p.m. members of de SIJIN [security police] and of the Police came onto the SENA premises and vollentlay attacked them, detaining twelve students who they took to the police station. the sdetained students were: LUIS MIGUEL ORDOÑEZ, EMILIO GONZALO OÑATE, JUDITH PAOLA ACOSTA, FABIO ANDRES MARTINEZ, JUANCARLOS MERA, MARIO FERNANDO DELGAD, LUZ ANGELICA DUEÑAS, JHONATAN VALLEJO, FRANCISCO JAVIER HIDALGO, and three more students whose name s we have not obtained. They were all photographed, filmed, and inspected, which to us seems very serious given the threat that hangs over student activists as well as trade union nd social leaders in this region of the country.

3. Santiago de Cali 17th October 2002

At 10:00 am, and in similar circumstances to the previous day, student AUGUSTO ORDONEZ and JAIME GIRALDO were detained. They were handcuffed and violently put into patrol car 715. And likewise students were wounded from being hit by tear gas cannisters: BETTY LUCIA LEVIN had to receive emergency medical assistance for stitches to a headwound; LEONARDO LINARES was in medical shock from serious injuries; JAIDER ARIAS, ANDERSON RAMIREZ, MAGALI SANDOVAL were injured; as were other students JORGE ANDRES DOMINGUEZ, NELSON MARTINEZ, ANDERSON MUÑOZ, NORBEY VASQUEZ, EFRAIN MENDOZA, JUAN CARLOS BASTIDAS all of whom suffered minor wounds.

Action Sought

We strongly reject the above outlined violations of the SENA students and workers right, and we ask for respect for the fundamental right to show disagreement with the government measures.

We seek an investigation into the abuse of power by members of the Mobile Anti-Riot Squadron of Santiago de Cali.

PRESIDENTE URIBE ORDENA REPRIMIR S.O.S. SINDESENA CON EL FIN DE ELIMINAR LA EDUCACION PUBLICA

La Asociación para la Investigación y Acción Social Nomadesc y las organizaciones pertenecientes a la "Campaña Nacional e Internacional de derechos humanos contra la Privatización la Corrupción y la Penalización de la Protesta Social", abajo firmantes, denunciamos ante la comunidad Nacional e Internacional los graves atropellos cometidos los días 16 y 17 de octubre de 2002, contra los Trabajadores y estudiantes del Servicio Nacional de Aprendizaje, SENA.

El día 15 de octubre fue enviado a las autoridades del orden regional, por parte de la Central Unitaria de Trabajadores CUT, un oficio donde se informa que "varias organizaciones filiales y sociales agrupadas en la CUT, realizaran el día 16 de octubre del presente una marcha que saldrá de las instalaciones del SENA a partir de las 8:30 a.m.. Lo anterior con el fin de que se nos brinde las garantías democráticas para esta actividad." Sin embargo la marcha pacifica fue reprimida brutalmente por parte de la Fuerza Pública, por orden del Alcalde de Santiago de Cali JHON MARO RODRIGUEZ mediante el decreto 0476 del 3 de octubre de 2002.

Antecedentes

Los trabajadores del Servicio Nacional de Enseñanza, SENA, afiliados a Sindesena, en uso de los derechos constitucionales de asociación y protesta vienen desarrollando desde hace tres semanas una Asamblea Permanente con el fin de denunciar ante la comunidad nacional e internacional, las políticas del gobierno de ALVARO URIBE VELEZ, quien ha impartido directrices al Ministro de Hacienda para recortar el presupuesto de la Institución.

Por orden del presidente se pretende reducir en trescientos noventa y cinco millones de pesos (395.000.000.00) el presupuesto del SENA lo que significa, una reducción de más del 50% del presupuesto para el año 2003, y como consecuencia una reducción del personal en igual porcentaje, modificar el plan de aprendizaje, reducción de las carreras que benefician a nivel nacional unos setecientos cincuenta y tres mil (753.000) alumnos de carreras cortas; setenta y ocho mil (78.000) estudiantes en trabajos calificados; Cuarenta y cinco mil (45.000) de carreras Técnico Profesionales; cincuenta y cuatro mil (54.000) de áreas profesionales intermedias y nueve mil doscientos (9.200) en areas tecnologicas.

Con estas medidas se materializa el acelerado proceso de Privatización de la Educación Publica, que quiere imponer el actual gobierno. Estas medidas obligaron al Sindicato a declararse en Asambleas Escalonadas y a convocar a una manifestación pública y una marcha en diversas ciudades, en razón, a que desde el día de hoy se discutirá en el Senado de la República dicho presupuesto. Los actos públicos se convocaron entre otras ciudades en Santiago de Cali Valle del Cauca y la ciudad de Pasto en el Departamento de Nariño, frente a las cuales se tomaron por parte del Gobierno Nacional y Municipal medidas represivas que han dejado consecuencias lamentables hasta el momento, como presentamos a continuación:

Los Hechos

1. Caso Santiago de Cali 16 de octubre 2002:

A eso de las 10:30 de la mañana, en la concentración efectuada en el SENA de Salomia, ubicado en calle cincuenta y dos con carrera segunda de la ciudad de Santiago de Cali, los miembros de la Fuerza Publica pertenecientes al Escuadrón Móvil Antimotines, ESMAC, arremetieron fuertemente con bombas de gas lacrimógeno, disparadas a la humanidad de los estudiantes y trabajadores y detuvieron por varias horas arbitrariamente a MIGUEL ANGEL HOYOS, Presidente de la Subdirectiva SENA Valle del Cauca, a los estudiantes JUAN CARLOS BASTIDAS, HAROL ROMAN ESTUDIANTES y heridos con Bombas de gas lacrimógeno los estudiantes DAVID VELASCO (quien pese a sus problemas de salud y de desplazarse en silla de ruedas se encontraba en la movilización), PABLO GARCIA, (herido en la cara con un Trooflay: lanza granadas) y SEBASTIÁN RUIZ.

2. Caso Nariño 16 de octubre 2002:

En medio de la coordinación de la Caravana por la defensa del SENA, Seccional Nariño, ubicado en la calle 22 este, numero 11 - 05 de la ciudad de Pasto y cuando los trabajadores y estudiantes de esta institución, se encontraban en el interior de las instalaciones, a eso de las 12:10 p.m. miembros de la SIJIN y de la Policía, ingresaron a los predios del SENA y arremetieron violentamente en su contra, deteniendo arbitrariamente a doce estudiantes y trasladándolos al comando de policía. Los Estudiantes detenidos fueron: LUIS MIGUEL ORDOÑEZ, EMILIO GONZALO OÑATE, JUDITH PAOLA ACOSTA, FABIO ANDRES MARTINEZ, JUANCARLOS MERA, MARIO FERNANDO DELGAD, LUZ ANGELICA DUEÑAS, JHONATAN VALLEJO, FRANCISCO JAVIER HIDALGO, y tres estudiantes más de los cuales a un no hemos obtenido sus nombres. Todos ellos fueron fografiados, filmados y reseñados, situación que nos parece de suma gravedad por la grave situación de amenaza en la que se encuentran los lideres sociales, sindicales, estudiantiles y de derechos humanos en esta región del país.

3. Santiago de Cali 17 de Octubre de 2002:

En iguales condiciones al día anterior y a eso de las 10:00, fueron detenidos los estudiantes AUGUSTO ORDONEZ y JAIME GIRALDO, quienes fueron esposados y introducidos violentamente en la patrulla 715. Igualmente estudiantes más fueron heridos, por el impacto de las bombas de gas lacrimógeno y debieron salir a recibir asistencia medica de urgencia BETTY LUCIA LEVIN, a quien le suturaron la herida por el impacto de una bomba de gas en el cráneo, LEONARDO LINARES, quien se encuentra en chequeo medico al parecer con fracturas graves, JAIDER ARIAS, ANDERSON RAMIREZ, MAGALI SANDOVAL. Igualmente fueron víctimas de lesiones menores los estudiantes JORGE ANDRES DOMINGUEZ, NELSON MARTINEZ, ANDERSON MUÑOZ, NORBEY VASQUEZ, EFRAIN MENDOZA, JUAN CARLOS BASTIDAS

Acciones Solicitadas

Por lo anteriormente expuesto rechazamos las graves violaciones a los derechos de los estudiantes y trabajadores del SENA y solicitamos el respeto a sus derechos fundamentales de manifestar su inconformidad con las medidas del gobierno.

Solicitamos se efectúen las investigaciones pertinentes por el abuso de autoridad por parte de los miembros del Escuadrón Móvil Antimotines de la Policía Metropolitana de Santiago de Cali.

Demandar del gobierno Colombiano que, antes de invertir más en la guerra en Colombia, amplíe el presupuesto para la educación, la salud y los servicios públicos.

Por ultimo que el gobierno Colombiano tenga en cuenta las legitimas solicitudes de los trabajadores y estudiantes del SENA, a quienes por defender la educación pública y el papel que ha jugado el SENA durante 45 años formando gratuitamente a los Colombianos, se les agrede físicamente y se les detiene arbitrariamente.

Por ultimo que el gobierno no siga dando un tratamiento de Orden Publico y de Guerra a los trabajadores y sectores sociales organizados en Colombia y que de manera urgente se siente a negociar y a buscar salidas concertadas con los Trabajadores y Estudiantes del SENA.
