PRESIDENTE URIBE ORDENA MILITARIZACIÓN DE LAS PLANTAS DE EMCALI E.I.C.E.

El sindicato de trabajadores de las Empresa Públicas de Cali, SINTRAEMCALI, denuncia ante la Comunidad nacional e internacional que por orden del Presidente de la República, ALVARO URIBE VELEZ, fueron militarizadas todas las plantas de trabajo de EMCALI E.I.C.E. con el objetivo de impedir el ingreso de los trabajadores a las instalaciones de Centro Administrativo C.A.M. y Bulevar, quines hasta el momento no han podido ingresar a sus sitios de trabajo.

Los hechos:

  1. En horas de la mañana del día de hoy 30 de septiembre, un contingente de Ejercito adscrito a la Tercera Brigada en operativo conjunto con efectivos de la Policía metropolitana de Cali y miembros del Escuadrón Móvil Antimotines, ocuparon las entradas del Centro Administrativo C.A.M., y de la Planta telefónica de Bulevar, impidiendo inicialmente a los trabajadores ingresar a sus sitios de trabajo y posteriormente la continuidad de la Asamblea Permanente que los trabajadores vienen desarrollando desde el pasado 25 de Septiembre a raíz del incumplimiento de los acuerdos firmados el 29 de enero de 2002, por el Gobierno Nacional y de las irregularidades que se han presentado por parte del Gerente de acueducto CARLOS VITALIANO SANCHEZ
  2. La militarización de las plantas de EMCALI E.I.C.E. se dio, por orden del presidente URIBE VELEZ, según lo expresa la Superintendente de Servicios Públicos Domiciliarios (E) MARIA DEL PILAR ORDSQEZ MENDEZ, al Comandante de la Tercera Brigada del Ejercito Nacional, JORGE PINEDA CARVAJAL y al Comandante de la Policía Metropolitana, OSCAR ADOLFO NARANJO TRUJILLO.
  3. En dicha solicitud la superintendente afirma que Atendiendo instrucción del doctor ALVARO URIBE VELEZ, presidente de la Republica, recibidas a travis de la doctora EVA MARIA URIBE TOBON, Superintendente de Servicios Públicos domiciliarios en propiedad. Atentamente acudo a usted con el fin de poner en su conocimiento la amenaza de toma de las instalaciones de la empresa EMCALI E.S.P, en próximos días, por parte de las fuerzas sindicales de la misma.

En razón a lo anunciado comedidamente le solicito ordenar las medidas que considere convenientes a fin de conjurar esta iniciativa y poder garantizar la continuidad de los servicios prestados por esta empresa, la integridad de todos sus trabajadores entre quienes se cuesta la delegación de esta entidad y la seguridad de sus instalaciones físicas.

Respetado Coronel le ruego adoptar las medidas de caracter preventivo suficientes que impidan la ocurrencia de cualquiera de los daños anunciados asm como seguir el curso que tomen los hechos, a fin de impedir que se afecte el orden en la ciudad de Santiago de Cali.

Para todos los efectos anteriores le solicito coordinar sus acciones con el agente especial designado por esta superintendencia para dirigir EMCALI E.S.P.; Dr. RODRIGO CAICEDO MONTALVO.

Antecedentes:

Desde el pasado martes 24 de septiembre, los trabajadores de EMCALI afiliados a SINTRAEMCALI, haciendo uso de los derechos constitucionales y normas internacionales que protegen a los trabajadores, se declararon en Asamblea Permanente, con el fin de solicitar al gobierno Colombiano dar cumplimiento a los acuerdos firmados el pasado 29 de enero de 2002, tendientes al salvamento y fortalecimiento de EMCALI E.I.C.E.

El sindicato denuncis la semana pasada la mala gestión del Gerente de acueducto VITALIANO SANCHEZ y del Jefe del Departamento de Mantenimiento Ingeniero JAIRO VILLAREAL, quienes han puesto en peligro la prestación del servicio de agua potable a mas del 70% de la población. Desde el nombramiento de este gerente la planta ha estado a punto de colapsar en dos oportunidades por falta de mantenimiento, pese a las reiteradas solicitudes verbales y escritas efectuadas por parte del sindicato, en donde se propone implementar un plan de choque consistente en el cambio de personal administrativo responsable de estas fallas, compra de materiales para el mantenimiento y reparaciones, solicitudes que nunca se tuvieron en cuenta.

Resaltamos la importancia estratigica de la Planta de Puerto Mallarino que provee de agua a mas del 70% de la población y que la antigestión del actual gerente tiene la clara intencionalidad de sumar un agente agresor mas para desestabilizar a EMCALI E.I.C.E., recurriendo a afectar seriamente a los usuarios de un servicio tan vital como es el agua.

CARLOS VITALIANO SANCHEZ, ha estado comprometido en la asesorma de empresas de servicios públicos y mineras que han sido privatizadas o que se encuentran en peligro de serlo, en regiones como la Costa Atlantica y cundinamarca. Ha sido consultor de Carbocol, Empresa que quedo en manos de la multinacional Drumon y de Minercol la cual han intentado liquidar en varias oportunidades.

Lo mas grave de todo es que la mala gestión del gerente de acueducto va en contravma de los acuerdos firmados por el Gobierno, en donde se y de los logros que los trabajadores han hecho a nivel del plan de salvamento de la empresa que incluye un importante ahorro operativo, mediante el trabajo que se ha efectuado en las Mingas Comunitarias,

Denunciamos que con los presentes hechos se pretende generar las condiciones para lanzar nuevamente una propuesta de privatización de EMCALI E.I.C.E. y ademas se violan flagrantemente los derechos de sindicación, asociación, expresisn y protesta, consignados en la Constitución Nacional y en las normas internacionales que protegen a los trabajadores en todo el Mundo.

Solicitamos a todos ustedes exigir del gobierno Colombiano respeto a estas garantmas y ante todo cumplimiento a los acuerdos firmado entre la ciudadanma, los trabajadores y el estado el pasado 29 de enero.

GOBIERNO DE URIBE DECLARA LA GUERRA A LOS TRABAJADORES DE EMCALI E.I.C.E

El Sindicato de Trabajadores de las Empresas Municipales de Cali, y los miembros de la Campaqa Nacional e Internacional de derechos humanos contra la privatización, la corrupción y la penalización de la Protesta Social, abajo firmantes, denuncian ante la comunidad nacional e internacional los graves hechos ocurridos en el día de hoy 1 de octubre de 2002, en los cuales resultaron heridos varios trabajadores producto de los impactos de Bombas de Gas Lacrimsgeno y artefactos explosivos con metralla lanzados por la fuerza Pública, particularmente de los miembros del Escuadrón Móvil Antidisturbios ESMAD, de la Policía Metropolitana de Santiago de Cali al mando de los Coronel CELIS.

Los Hechos:

  1. Los trabajadores de las tres plantas de EMCALI E.I.C.E. acueducto y alcantarillado, Comunicaciones y Energía, fueron brutalmente agredidos por la Fuerza Pública en desarrollo de la Asamblea Permanente, a la cual se vieron obligados producto de la nueva amenaza de privatización de las Empresas Municipales de Cali, del incumplimiento por parte del gobierno nacional, a los acuerdos firmados el pasado 29 de enero de 2002 y particularmente a la crisis generada por el Gerente de Acueducto y alcantarillado CARLOS VITALIANO SANCHEZ, quien en cuatro meses ha hecho colapsar dos veces la planta de Tratamiento de agua potable de Puerto Mallarino que abastece al 70% de la comunidad caleña.
     
  2. Los hechos iniciaron a eso de las 9:30 de la Maqana en la Planta de Alcantarillado ubicada en Kr. 15 No.59-85, donde un dispositivo conjunto del Ejercito y la Policía Nacional, llegs lanzando bombas de gas lacrimígeno y Artefactos explosivos con metralla, los cuales hirieron a dos trabajadores de esta planta, mientras tres de ellos debieron salir a servicios midicos de urgencia con síntomas de asfixia.
     
  3. En menos de 20 minutos fueron lanzadas mas de 50 bombas de gas lacrimígeno en la Planta de Alcantarillado artefactos Prohibidos por el derecho Internacional Humanitario por sus caractermsticas mortales y que corresponden a la denominación MODEL 7290 FLASH BANG, 1.5 SECOND DELAY U.S, MADE IN USA, y otras igualmente nocivas pero de menor potencia GREN HAND A/RIOT IRRT SMK MULTIPLE PN770 1063 SP 98 CS.
     
    En esta planta la Fuerza Pública ataco nuevamente a los trabajadores a eso de la 1:30 p.m. justo cuando los estudiantes de un colegio cercano a alcantarillado, salman de clases poniendo en peligro la integridad de mas de un centenar de menores de edad.
     
  4. Posteriormente y a eso de las 10:30 de la maqana se inicio un operativo en contra de los Trabajadores de acueducto en la Planta de Bodegas Navarro ubicada en la Trasversal 25 No 27 A 40, en donde igualmente la Fuerza Pública arremetis contra los trabajadores con bombas de gas MODEL 7290 FLASH BANG, las cuales calleron muy cerca del directivo de SintraEMCALI, que se encontraba presentando un informe a mas de 100 trabajadores concentrados a esa hora en la planta igualmente los gases fueron lanzados en la bodega donde se guardan los implementos de trabajo.
     
  5. A eso de las 12:30 p.m. en la Planta de Telecomunicaciones de Colon ubicada en la Calle 14 No. 33 _40 los miembros del Escuadron Msvil Antimotines arremetieron contra los trabajadores lanzando gases que apuntaban directamente a la humanidad de los obreros y usuarios. En Colon lanzaron gases lacrimígenos sobre el centro de atención al público, en el justo momento en el que se estaba atendiendo a la comunidad en el pago y reclamo de servicios públicos. Los gases impactaron sobre las ventanas del centro de atención afectando a los funcionarios de Megabanco, Banco de Occidente, los Oficiales de atención al público de EMCALI E.I.C.E, los guardas de seguridad de la empresa Gran Colombia que presta sus servicios en esta planta.
     
    Otros gases Lacrimígenos impactaron sobre la ventana del Almacén de Colon, donde permacen las tarjetas que se utilizan en la planta de telecomunicaciones para su funcionamiento. Igualmente otros calleron en toda la planta de Colon afectando a los trabajadores de EMCALI E.I.C.E. y a los trabajadores de la compañia de Aseo Servm limpieza.
     
    Igualmente la Fuerza Pública dispuso de tanquetas de propulsión de agua lanzando los chorros hacia la Central de Comunicación donde habían roto los vidrios con los gases lacrimígenos poniendo en peligro los equipos que se utilizan en la atención a la comunidad. Así mismo los gases afectaron a las unidades residenciales que se encuentran en los alrededores de la Telefónica
     
    Durante estos hechos y cuando los miembros de la Asociación de derechos humanos Nomadesc, se desplazaron para verificar las denuncias, justo en el momento en que se disponían a denunciar como la fuerza Pública agredía a los trabajadores, lanzaban gases que afectaban de la comunidad y provocaban a los trabajadores, fueron amenazados de muerte por parte de uno de los agentes de Escuadron Móvil Antimotines, que con seqales les decman que los tenman en la mira y les apuntaban con un lanza granadas.
     
    Los miembros de Nomadesc se desplazaron para buscar al comandante de la Policía que dirigía el operativo y denunciar los hechos quienes con una actitud agresiva evadieron la identificación del agente que los amenazo, motivo por el cual se comunicaron con el Coronel Novoa de la Policía, con la Defensoria del Pueblo y la Procuraduría Regional, logrando que esta ultima llegara hasta la Telefónica de Colon y verificara los hechos denunciados.
     
  6. Simultaneamente la Fuerza Pública atacaba a los trabajadores de Energía concentrados en el Centro de Atención de Energía Zona Sur CAES, en la Kr 80 No. 18 _12, a quienes lanzaron gases lacrimígenos y disparos al aire rompiendo la puerta de entrada, y intentando ingresar por la fuerza.
     
    Resaltamos que los trabajadores de EMCALI E.I.C.E. han garantizado la prestación de los servicios Públicos en toda la ciudad, pese a los graves hechos y la arremetida de la fuerza Pública en su contra.
    Manifestamos que el Gobierno nacional en cabeza del presidente de la República ALVARO URIBE VELEZ, la Superintendente de Servicios Públicos domiciliarios EVA MARIA URIBE TOBON y los altos mandos militares y de la policía, son responsables del tratamiento de guerra dado a un conflicto social y a las justas reclamaciones de los trabajadores para continuar contribuyendo a la defensa de una empresa Industrial y Comercial del Estado que propenda por el beneficio de toda la comunidad.
     
    Sabemos que el interis del presidente URIBE y de la Superintendente URIBE, es de Privatizar a EMCALI E.I.C.E., tal como lo manifestara el propio mandatario en la reunión efectuada en Santiago de Cali dos días despuis de su posesión al proponer que EMCALI debía ser una sociedad por acciones y para ello recurren al uso de la fuerza y a violar los mas elementales derechos de los trabajadores.
     
    Solicitamos dirigirse al alto gobierno para exigir el cumplimiento a los acuerdos firmados con los trabajadores y evitar una catastrofe sin precedente alguno en la ciudad de Santiago de Cali.

CAMPANA NACIONAL E INTERNACIONAL DE DERECHOS HUMANOS CONTRA LA CORRUPCIÓN, LA PRIVATIZACIÓN Y LA PENALIZACIÓN DE LA PROTESTA SOCIAL

PRESIDENT URIBE ORDERS THE MILITARY OCCUPATION OF EMCALI EICE WORK PLANTS

SINTRAEMCALI, the Cali Public Services trade union, denounces to the national and international community the action of President Alvaro Urribe who has ordered the military occupation of EMCALI work plants. This action aims at preventing workers from entering the CAM - Central Administration Building and Bulevar (another work plant). Up until now no workers have been able to enter and carry out their duties.

The Events:

  1. In the early hours of 30th September, a contingent of military personnel from the Third Brigade accompanied by the local police and an anti -riot squad occupied the entrances to both the CAM Tower administration building and the Bulevar Telephone office. Initially they prevented the entrance of workers, and later disrupted the Permanent Assembly that workers have been carrying out since 25th September due to the failure of the government to fulfil signed agreements with the trade union which were agreed on 29th January, and also in protest at the actions of the water manager CARLOS VITALIANO SANCHEZ
  2. The order for the military takeover of the plants was given directly by President AlvaroUribe Velez, according to the Superintendent of Public Services MARIA DEL PILAR ORDSQEZ MENDEZ, the commander of the Third Brigade JORGE PINEDA CARVAJAL and the Commander of the Metropolitan Police OSCAR ADOLFO NARANJO TRUJILLO.
  3. The Superintendent stated that Alvaro Uribe had ordered the military occupation of the plants via the Superintendent of Public Services due to a fear that the trade union and its members were planning to occupy the installations. Authorisation was given to use all necessary measures to prevent workers from occupying the installations and to ensure the continued provision of services provided by the company, and the security of the infrastructure.

Background:

Since 24th September EMCALI workers affiliated to the trade union SINTRAEMCALI have exercised their constitutional rights and international norms to carry out a 'Permanent Assembly' with the aim of pressuring the government to fulfil its obligations under an agreement signed with the trade union on 29th January 2002 aimed at strengthening and saving EMCALI EICE. The trade union last week denounced the bad management of water plant manager

VITALIANO SANCHEZ and the head of the Maintenance Department JAIRO VILLAREAL, who have both put in jeopardy the provision of water to more than 70% of the local population. Since the appointment of the Water Manager the plant has been on the verge of collapse two times, despite the verbal and written protestations of the trade union. The union called for a 'Shock Plan' which would remove those in the administration responsible for these acts, and extra financial measures to pay for necessary equipment and repairs. The union received no response.

The Puerto Mallarino Plant is crucial for the supply of water to the city of Cali -responsible for nearly 70% of the population's water supply. The union suspects that the actions of the manager are a deliberate attempt to destabilise the company and seriously effect the provision of water to the local population.

CARLOS VITALIANO SANCHEZ, was involved as an adviser in the public services and mining industries in the Atlantic Coast and Cundinamarca regions which have been privatised. He was a consultant for Carbocol, a company that has now been brought by Drummond and Minercol.

The most serious of all is that the action of the manager goes against signed agreements between the Colombian government and the trade union which aimed at guaranteeing the survival of the company and the implementation of cost saving measures such as Mingas Comunitarias (Community Work-ins) where workers give up their weekend to work for free carrying out repairs.

We denounce these attempts that seek to yet again provide the terrain for the privatisation of the company EMCALI E.I.C.E and furthermore we also denounce the blatant violation of basic trade union rights of association, expression and protest which are protected in both the National Constitution and International norms that protect workers rights throughout the world.

We call on all of you to demand that the Colombian government respect these minimal guarantees and above all that they fulfil obligations signed in the 29th January 2002 Agreement.

URIBE'S GOVERNMENT DECLARES WAR ON THE WORKERS OF EMCALI E.I.C.E

SINTRAEMCALI, the Municipal Corporation of Cali Workers Trade Union, and the undersigned members of the National and International Human Rights Campaign Against Privatisation, Corruption and the Criminalisation of Social Protest denounce to the national and international community the serious events that happened today, 1st October 2002, in which several workers have been injured as the result of being hit by tear gas bombs and shrapnel grenades thrown at them by the state security forces, particularly by members of the Mobile Anti-Riot Unit ESMAD of Cali Metropolitan Police under the command of Colonel CELIS.

The Events:

  2. The incident started at 9:30 in the morning at the Sewerage Treatment Plant located at No.59-85, 15th Street when a joint team of Army and National Police arrived throwing tear gas bombs and shrapnel grenades, wounding two workers at this plant, while three others with symptoms of asphyxia had to leave immediately for emergency medical treatment.
     
  3. 50 tear gas bombs were thrown in the space of 20 minutes into the Sewerage Treatment Plant. These are prohibited in international law because of their fatal characteristics. They were of the type MODEL 7290 FLASH BANG, 1.5 SECOND DELAY U.S, MADE IN USA. Others used, equally noxious but less powerful, were GREN HAND A/RIOT IRRT SMK MULTIPLE PN770 1063 SP 98 CS.
     
    The security forces launched a renewed assault on the workers in this plant at 1:30 p.m., just as students from a nearby college were coming out of their classes - putting the lives of more than one hundred minors in danger.
     
  4. Previously, from 10:30 a.m. another operation was launched against the workers at Bodegas Navarro Plant, situated at No 27 A 40 25th street, where again the state forces attacked the workers with MODEL 7290 FLASH BANG tear gas bombs, which fell very close to the leaders of SINTRAEMCALI, who were there giving a report to more than one hundred workers gathered at the plant. The gas bombs were also thrown into the cellar where the work implements are stored.
     
  5. Then at 12:30 p.m. at the Colon Telecommunications plant, situated at Nos. 33-40 on 14th Street, members of the Mobile Anti-Riot Unit assaulted the workers by throwing gas canisters in a way that put their and customers' lives at risk. The state forces threw the tear gas at the public service centre, just where members of the community were in attendance to pay for their public services. The missiles hit against the windows of the centre, and affected the staff of Megabanco, of Banco de Occidente, and EMCALI's own customer service workers, as well as the security guards from Gran Colombia corporation who provide services to this plant.
     
    Other tear gas canisters hit the windows of Colon Warehouse, where functioning telecommunications equipment is stored. Meanwhile, tear gas canisters were falling across the whole plant affecting all its EMCALI EICE workers and cleaning workers from the Washroom Services company.
     
    The state forces deployed tanker vehicles with water cannon directed at the broken windows of the Communications Centre, putting at risk equipment that is being used for the benefit of the community. At the same time the tear gas was also affecting people in residences in the surrounding area.
     
    During these events members of NOMADESC human rights association arrived to confirm the reports of an attack. Just as they were getting ready to protest the conduct of the state forces, throwing tear gas that provoked the workers and affected the community, the NOMADESC workers were threatened with death by one of the Anti-Riot Squad agents, who signaled that they were in his sights and that they would be the next to be hit with a grenade attack.
     
    The NOMADESC workers sought out the Police commander directing the operation and protested what was happening. He aggressively refused to identify the agent who had made the death threat, so they then communicated with Coronel Novoa of the Police, with the Ombudsman and the Regional Prosecutor, managing to get this last official to come to the Colon telephone centre to verify what had been going on
     
  6. Simultaneously, state forces were attacking the electricity workers gathered at the South Zone Energy Centre CAES, which is at Kr 80 No. 18 -12. They threw tear gas and shot into the air, breaking the entry gate and tried to enter by force.
     
    We emphasise that the workers EMCALI EICE have guaranteed the supply of public utility services to the whole city, in spite of these serious events and the assault against them by the state forces.
     
    We point out that the national Government headed by President of the Republic ALVARO URIBE VELEZ, Superintendent of Domestic Public Services EVA MARIA URIBE TOBON and the highest officers of the military and the police are responsible for this warlike treatment of a social conflict and the just demands of the workers to continue contributing their defence of EMCALI as a Industrial and Commercial State Corporation (EICE) that operates for the benefit of the whole community.
     
    We know that the interest of URIBE and his Superintendent, is to Privatise EMCALI EICE, as has already showed when two days after his inauguration he came to Cali to say that that EMCALI should be a share holding company, and now he has resorted to the use of force violating the workers' most basic rights.
     
    We ask you to direct protests to the Colombian government demanding that the Agreement it signed with the workers on 29th January 2002 be implemented, and to avoid a catastrophe without precedent in the history of the city of Santiago de Cali.

  2. Official DAS creditation has been withdrawn from eleven bodyguards of the trade union leaders detained on Friday 20th September. These comrades were part of a Humanitarian Delegation taking food, mediciines and blankets to peasants surrounded by army units in neighbouring Cuaca department. The Humanitarian Delegation was held for 14 hours to stop it from bringing relief to the peasants.
  3. The University of Valle de Cauca in Cali has announced it has to cut a hundred workers. The union SINTRAUNICOL has a programme of workshops and protests to mobilise against these sackings.
