Hamburg: Afrikanischer Flüchtling und anti-rassistischer Aktivist verhaftet

Senfo TONKAM,
Afrikanischer Flüchtling und anti-rassistischer Aktivist
wurde wegen seinem Kampf gegen Rassistische Polizeikontrollen
verhaftet und ins Gefängnis geworfen.

Senfo Tonkam wurde in seiner Wohnung in Hamburg heute am 14. April 2002 von der deutschen Polizei in einer aggressiven
Aktion festgenommen und verhaftet. Er wurde zum Polizeikommissariat 41 (Sievekingdamm 20, 20535 Hamburg) gebracht und
von dort ins Gefängnis (Justizvollzugsanstalt Holstenglacis 3, 20355 Hamburg) verlegt.

Zum Hintergrund:

Am 8. November 2000 haben Polizeibeamte vom Bundesgrenzschutz in einem Zug zwischen Magdeburg und Braunschweig
unseren Kamaraden Senfo kontrolieren wollen. Senfo war der einzige Schwarze im Abteil. Die Polizei ist direkt zu ihm
gekommen und wollte nur von ihn (als einzige Schwarze Person unter mehr als 50 Weißen) die Personaldokumente
überprüfen. Natürlich hat sich Senfo geweigert und auf seine Frage, weshalb nur er kontrolliert würde, haben die Polizisten
geantwortet, dass sie nach illegalen Einwanderern suchen würden.

Senfo hat darauf hingewiesen, dass es sich um einen Rassistischen Akt handelt, wenn nur er kontrolliert wird und die
Polizisten davon ausgehen, dass alle Schwarzen illegal oder kriminell sind. Senfo hat sich geweigert, ihnen seinen Ausweis zu
zeigen, wenn nicht auch die Weißen im Zugabteil kontrolliert werden und bereits angekündigt, die Beamten wegen Rassismus
anzuzeigen.

Zu unserer Überraschung wurde Senfo wegen Beleidigung von den Beamten angezeigt. Am 28. Mai 2001 wurde Senfo
TONKAM, Generalsekretär von SOS Struggles of Students, Präsident der African Refugees Association und Aktivist der
Black Students Organisation und der Black Community, vom Amtsgericht in Braunschweig wegen Nicht-Vorzeigen seines
Ausweises verurteilt. Senfo sollte eine Strafe von insgesamt 153,94 Euro bezahlen. Aber Senfo weigert sich, diese rassistische
Strafe zu akzeptieren.

Die Gründe zur Weigerung der Zahlung

Es ist klar, dass die Personenkontrolle vom 8. November 2000 ein rassistischer Akt der Polizei gegen ein Mitglied der Black
Community war. Es ist auch deutlich, dass die Verurteilung von Senfo zur Zahlung von 153 Euros oder 5 Tagen
Ersatzfreiheitsstrafe auf einer rassistischen Grundlage beruht. Die Zahlung dieser Strafe würde den staatlichen Rassismus
legitimieren.

Unsereaktuellen und zukünftigen Aktionen :

Am heutigen 14. April 2002 haben ca. 50 Personen der Black Community in einer spontanen
Demonstration gegen die rassistische Verhaftung von Senfo Tonkam protestiert. Solche Demonstrationen werden weiter
fortgesetzt, um gegen institutionellen Rassismus zu demonstrieren.

Wir bitten alle Schwarzen und Nicht-Deutsche, sich nicht länger rassistischen Kontrollen durch
die deutsche Polizei auszusetzen.

4.Verlangtin den Briefen a) dass Ende von rassistischen Kontrollen und Repression durch die
deutschePolizei gegen Schwarze Menschen in Deutschland und b) dass Ende der Kriminalisierung
der Schwarzen
Bewegungin Deutschland.
Befreit Senfo! Stoppt die Repression gegen die Black Community in Deutschland!

Senfo TONKAM, African refugee and activist against racism was arrested and thrown into jail for
resisting racist police controls.

Today, on April 14, 2002, Senfo Tonkam was arrested and taken into custody by the German police in an aggressive
manoeuvre. He was taken to Polizeikommissariat 41 (Sievekingdamm 20, 20535 Hamburg) and then transferred to prison
(Justizvollzugsanstalt Holstenglacis 3, 20355 Hamburg).

Background information:

On November 8., 2000, officers of the German Federal Border Police wanted to check the identification of our comrade Senfo in
a train travelling between Magdeburg and Braunschweig. Senfo was the only Black person in the compartment. The police
officers headed straight for him and of all passengers (more than 50, all of them white) wanted to check only his personal
documents. Of course, Senfo refused to oblige. On asking why only he was being checked he was told they were looking for
illegal immigrants.

Senfo pointed out that it was a racist act if only he was checked and the officers assumed that all Blacks were illegal or
criminals. Senfo refused to show his passport if the white passengers were not equally checked. He also announced at the
time that he would press charges against the officers for
being racist.

To our great surprise it was Senfo who was reported for insulting the officers. On May 28, 2001 Senfo TONKAM, general
secretary of SOS Struggles of Students, president of the African Refugees Association, acivist of the Black Students
Organisation and of the Black Community was convicted by the Inferior Court (Amtsgericht) Braunschweig for not showing
his passport. Senfo was to pay a fine totaling 153,94 Euro. But Senfo refuses to accept such a racist punishment.

Reasons for refusing to pay the fine:

It is evident that the police control of November 8, 2000 was a racist act of the police against a member of the Black
Community. It is also clear that Senfo's conviction to paying a fine of 153,94 Euro equaling 5 days of prison by way of
substitution are based on a racist ideology. Paying the fine would legitimize the institutionalized racism of the state.

Our current and future activities:

Today, on April 14, 2002, about 50 members of the Black community protested against the
racist arrest of Senfo Tonkam in a spontaneous demonstration. Such demonstrations will
continue to protest against institutionalized racism.

avoir Résisté à un Contrôle de Police Raciste.

Senfo Tonkam a été arrêté à son domicile de Hambourg ,ce 14 Avril 02 par la Police allemande particulièrement agressive a
cette occasion. Il a été conduit au poste de Police no 41 de Hamburg (Sievekingdamm 20, 20535 ),d´ou il a été transféré a la
prison de Hambourg où il est supposé passer 5 jours en tant que prisonnier.

Rappel des faits :

Le 9 Novembre 2000, des Officiers de la Police des Frontières Allemandes ont voulu contrôler le Camarade Senfo dans le train
entre Magdebourg et Braunschweig. Senfo était le seul Noir dans le wagon. La police est venue directement vers lui et c?est à
lui seul (parmi plus de 50 personnes en majorité des Blanc/hes) que les policiers ont demandé de montrer les papiers.
Evidemment, Senfo a refusé et à sa question pourquoi ce n?est que lui qu?ils contrôlaient, les policiers ont répondu qu?ils
cherchaient les immigrants illégaux. Et Senfo leur a fait remarquer que le fait qu?ils ne contrôlent que lui seul prouvait que pour
eux, tout(e) Noir(e) est nécessairement ou potentiellement illégal(e) et criminel(le) et que cela s?appelle du racisme, de la
discrimination raciale et de la criminalisation raciste. Senfo a refusé de leur montrer les « papiers » tant qu?ils n?auraient
pas contrôlé tous les Blancs/ches qui sont dans le wagon et il a promis de leur porter plainte pour racisme et discrimination
raciale.
A notre surprise, c?est plutôt la police qui a porté plainte contre Senfo pour «insultes ». Le 28 Mai 2001, le camarade Senfo
TONKAM, Leader de SOS - Struggles of Students et de l?Association des Réfugié(e)s Africain(e)s-ARA et Militant de la
Black Students? Organisation-BSO avait été injustement condamné par le Tribunal de Braunschweig pour avoir refusé de
montrer ses papiers lors du contrôle de police raciste évoqué plus haut. L?appel intenté par ses avocats ayant été rejeté par
la Cour, Senfo devait payer une amende de 153, 94 EURO à l?Etat. Mais Senfo , a refusé de payer cette amende , pour éviter
l?emprisonnement.

Les Raisons de notre refus de payer :

Il est manifestement clair que le contrôle dont a été l´objet Senfo le 09 Mai 2000 était un acte raciste de la police dirigé contre
un noir , supposé illégal.
Il ne fait aussi pas de doute que la condamnation de Senfo par la justice à payer 150 Euros ou à purger 5 jours de prison ,qui
s´en est suivie est également une condamnation raciste .
Accepter de payer l´amende ou de purger la peine de prison reviendrait à cautionner et légitimer le racisme et l?arbitraire
de l?Etat Allemand contre les noirs en particulier et les étrangers en général.

Les actions présentes et futures :

Ce 14 avril déjà, une cinquantaine de personnes , en majorité de la communauté noire a Hambourg
ont manifesté contre l´arrestation raciste dont a été victime le camarade Senfo Tonkam. De telles
manifestations doivent continuer pour protester contre le racisme institutionnalisé dont sont victimes les étrangers en
général et les noirs en particulier

De plus, nous invitons tous les noirs et les étrangers à refuser de se soumettre aux contrôles
ségrégationnistes et racistes de la police Allemande ,qui sont malheureusement fréquents à Hambourg et dans toute
l´Allemagne
